Copyright and Disclaimer

You are likely reading this page because of a reference in an email message from me. Most of what you're about to read is just "common sense" on the net, or has been common sense in the past. Given the volume of mail I create, and the wide-ranging group of people with whom I correspond in various roles, I feel the obvious must be stated. This is also a convenient place to explicitly indicate the licenses for my work when I correspond with various open source projects.

Message shall refer to any piece of electronic correspondence including, but not limited to email, usenet posting, electronic "bulletin board" postings, web pages, message archives including, but not limited to, mailing-list specific archives, HTTP accessible archives such as DejaNews, search engines such as Google, ftp archives of mailing lists, and usenet or web CD-ROM compilations.

I am Dean Gaudet, and in the distant past I used PGP to sign some messages with this PGP key (but I've since forgotten the passphrase). Since complete security of my signature is not feasible with present technology, there is no guarantee that any signed message bearing the name "Dean Gaudet" was actually written by me. In no event shall an unsigned message from "Dean Gaudet" be guaranteed to have been written by me. To reiterate, there is absolutely no feasible system by which you can electronically verify that you are receiving unaltered communications from me.

In the event that a message from Dean Gaudet regards open source software including, but not limited to, Apache, or Linux, and if that message contains a program modification commonly referred to as a "patch", or if that message contains documentation intended to support said open source software, then unless otherwise specified in said message the contents of said message are made available under the copyright license of said open source software, however said message shall still be subject to the Disclaimer that follows. By way of an example, if Dean Gaudet provides a patch to Apache then it is implicitly released under the Apache LICENSE. In the event that said open source software is in the public domain, then said patch is released into the public domain.

In the event that a message from Dean Gaudet does not regard open source software, or does not include a program modification or supporting documentation for open source software, or is not otherwise covered by the previous paragraph, then said message shall be referred to as a non-free message. All non-free messages from Dean Gaudet are Copyright © 1986-2015 Dean Gaudet, and all rights are reserved.

Non-free messages from Dean Gaudet may be copied and distributed on a limited basis for noncommercial purposes only, provided that any material copied remains intact and that all copies include the following notice in a clearly visible position:

These materials may not be copied or redistributed for commercial purposes or for compensation of any kind without prior written permission from Dean Gaudet. Disclaimer: All messages from Dean Gaudet are provided by Dean Gaudet ``as is'' and any expressed or implied warranties, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose are disclaimed. In no event shall Dean Gaudet be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, procurement of substitute goods or services; loss of use, data, or profits; or business interruption) however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use of said messages, even if advised of the possibility of such damage.

Any opinions or positions expressed in messages from Dean Gaudet are exclusively the opinions of Dean Gaudet and do not represent the opinions of his employers, the Apache Group, or any other group or individual.
